What is an
88G Certificate?
This is a certificate issued under Section 88G of the
Conveyancing Act 1919 in which advice is given by Council as to whether any
amount is payable to Council because of a failure to comply with a positive
covenant imposed on the title of a property in which Council is named as the
authority benefited by that positive covenant. Also advice is furnished as to
whether any works have been carried out by Council under terms of such a
positive covenant, the cost of which may be recovered by Council from the
proprietor of the property.
What is the
cost for an 88G Certificate?
As at 1 January 2007 the fee for an application of
Section 88G Certificate will be $10.00 and Council will
not inspect the relevant land for the purpose of issuing the certificate.
How can I
apply for an 88G Certificate?
Applications can be made online via Council’s Online
Services Portal and will need to be accompanied by a copy of the 88B
instrument and current fee.
Select the Certificates menu and the New
Certificate. Follow the steps and you
will need to attach an electronic copy of the 88B instrument on the Certificate
Details Page
